Arizona Court Upholds Law From 1864

On Tuesday, April 9, 2024,  Arizona’s Supreme Court ruled in favor of the state’s 1864 ban on abortion. The 1864 law prohibits nearly all abortions.

Roe V. Wade

The U.S. Supreme Court’s Roe v. Wade decision in 1973 had overwritten that law. However, the more recent Dobbs ruling overturned the Roe law. This made the way for Arizona’s abortion ban to go back into effect. Nonetheless, Planned Parenthood continued to challenge the law despite its exceptions for life-threatening emergencies.

Court Work

After yesterday’s ruling, the abortion ban is back in force. The Arizona Supreme Court ruled Tuesday to uphold the state’s pro-life law as written in 1864 by overturning a lower court decision that misinterpreted the law. The lower court tried to allow abortion in circumstances where the Arizona Legislature prohibited it.

We celebrate the Arizona Supreme Court’s decision that allows the state’s pro-life law again to protect the lives of countless, innocent unborn children.

This was a huge pro-life victory, in which the Arizona Supreme Court ruled that the state could enforce its abortion ban and protect babies from abortions.
